L’article 4-1 du décret n°67-223 du 17 juillet 1967 énonce les surfaces à exclure du calcul de la superficie des parties privatives des lots de copropriété.

Ainsi, ne sont pas à prendre en compte dans le calcul de la surface d’un appartement les éléments suivants :

  • murs,
  • cloisons,
  • marches et cages d’escalier,
  • gaines,
  • embrasures de portes et de fenêtres,
  • planchers des parties des locaux dont la hauteur sous plafond est inférieure à 1,80 mètre.

Le dispositif SCELLIER (article 199 septvicies du code général des impôts), mis en place par la loi n°2009-594 du 27 mai 2009, permet de bénéficier, dans les conditions ci-après énumérées, d’une réduction d’impôt équivalente à 25% du montant investi.

La réduction d’impôt est calculée sur le prix de revient du logement retenu pour sa fraction inférieure à 300 000 €.

Ainsi, la réduction d’impôt ne peut être supérieure à 8 333,33 €/an sur une période de 9 années.

Types de biens éligibles au dispositif SCELLIER :

- logement neuf ou en l’état futur d’achèvement acquis entre le 01/01/2009 et le 21/12/2012,

- logement construit par le contribuable dont le dépôt de demande de permis de construire a été effectué entre 01/01/2009 et le 21/12/2012,

- local affecté à un usage autre que l’habitation et transformé en logement acquis entre le 01/01/2009 et le 21/12/2012,

- logement ne satisfaisant pas aux caractéristiques de décence prévues à l’article 6 de la loi n°89-462 du 6 juillet 1989 ayant fait l’objet de travaux (définis par décret) leur donnant les caractéristiques d’un logement neuf, les travaux devant intervenir entre le 01/01/2009 et le 21/12/2012.

Plafonnement du loyer et engagement de durée :

Pour bénéficier de ce dispositif  l’acquéreur doit s’engager à donner à la location, à titre d’habitation principale, son acquisition, pour une durée ne devant pas être inférieure à 9 ans.

En outre, le loyer exigé devra être inférieur aux plafonds prévus à l’article R441-20-1 du code de la construction et de l’habitation.

Soit :

- ZONE A : 21,65 euros/mois/m²

- ZONE B1: 15,05 euros/mois/m²

- ZONE B2 : 12,31 euros/mois/m²

- ZONE C : 9,02 euros/mois/m²

La ville de Nice se situe en zone A.

Ainsi, un appartement de 50 m² (loi Carrez) situé à Nice devra avoir un loyer mensuel maximum de 1 082,50 €/mois.

Exemple :

Vous payez 10 000 € d’impôt sur le revenu par an.

Si vous faite l’acquisition à Nice d’un appartement neuf de 75 m² pour une somme de 300 000 €, et que vous vous engagez à le louer pour une période de 9 années à un loyer mensuel maximum de 1 623,75 € (loyer bien supérieur au prix du marché)

Votre impôt sur le revenu ne sera plus que de 1 666,67 € par an pendant neuf ans à compter de votre acquisition.
